Article 1 – Definitions

  • Entrepreneur: the natural or legal person who offers products and/or services via the webshop to consumers (B2C) and business customers (B2B).
  • Consumer: a natural person not acting in the course of a trade or profession, who enters into an agreement with the entrepreneur.
  • Business customer: a legal or natural person acting in the course of a trade or profession, who enters into an agreement with the entrepreneur.
  • Agreement: the purchase contract concluded between the entrepreneur and the customer (consumer or business customer) via the webshop.

Article 2 – Applicability

These terms and conditions apply to every offer by the entrepreneur and to every distance contract concluded between the entrepreneur and a consumer or business customer.

Article 3 – The Offer

  • The offer contains a complete and accurate description of the products offered.
  • Obvious mistakes or errors do not bind the entrepreneur.
  • For business customers, specific price agreements or different conditions may apply, which must be agreed upon in writing.

Article 4 – The Agreement

  • The agreement is concluded at the moment the customer accepts the offer and meets the associated conditions.
  • The entrepreneur shall confirm receipt of the acceptance of the offer without delay by electronic means.
  • For business customers, the entrepreneur may request additional information to confirm the agreement.

Article 5 – Right of Withdrawal (B2C only)

  • The consumer has the right to withdraw from the agreement within 14 days of receiving the product, without giving any reason.
  • During this period, the consumer shall handle the product and packaging with care.
  • If exercising the right of withdrawal, the consumer shall return the product with all supplied accessories in accordance with the applicable return policy.
  • This right of withdrawal does not apply to business customers (B2B).

Article 6 – Costs in Case of Withdrawal (B2C)

  • If the consumer exercises the right of withdrawal, the return costs are borne by the consumer.
  • The entrepreneur will refund the purchase price within 14 days after receipt of the return shipment.

Article 7 – Prices

  • The prices of the offered products will not be increased during the validity of the offer.
  • All prices include VAT for consumers and exclude VAT for business customers, unless otherwise stated.
  • Business customers receive an invoice with specified VAT (if applicable).

Article 8 – Delivery and Performance

  • The entrepreneur will exercise the utmost care when receiving and executing orders.
  • Delivery takes place while stocks last.
  • The risk of damage and/or loss remains with the entrepreneur until delivery to the consumer.
  • For pallet orders, the risk passes at the moment of delivery to the carrier.

Article 9 – Payment

  • Payment is always made in advance, unless otherwise agreed in writing.
  • Until payment has been received, the order will not be processed or shipped.

Article 10 – Corrected Invoice Without VAT (Intra-Community Supply)

  • During the ordering process, the customer must provide a valid VAT number to qualify for an invoice without VAT.
  • If this is not provided and VAT is charged, Gockel Original Cornhole may, upon request, issue a corrected invoice without VAT, provided a valid VAT number is supplied and legal requirements are met.
  • An administration fee of €25 will be charged for processing and reissuing such invoices.
  • These costs must be paid in advance.
  • This ensures correct and timely processing of invoices for our customers.

Article 11 – Payment via Billie

  1. Gockel Original Cornhole cooperates with Billie GmbH (“Billie”), an external payment service provider, for the processing of payments by invoice.
  2. If the customer chooses to pay afterwards via Billie, payment must be made exclusively to Billie in accordance with the instructions on the Billie payment confirmation.
  3. Payments made directly to Gockel Original Cornhole do not constitute valid payment, are not processed automatically, and may result in:
    • delays in processing or delivery;
    • additional administration costs of €25 per incorrect payment.
  4. If a customer accidentally pays directly to Gockel Original Cornhole, they must immediately contact info@gockel-cornhole.com so the payment can be correctly processed in coordination with Billie.
  5. Using Billie allows customers to pay safely and conveniently after receiving goods or services.

Article 12 – Warranty

  • The entrepreneur guarantees that the products comply with the agreement and the specifications stated in the offer.
  • For consumers, statutory warranty provisions apply.

Article 13 – Complaints Procedure

  • The entrepreneur has a sufficiently publicized complaints procedure.
  • Complaints about the execution of the agreement must be submitted to the entrepreneur within 7 days after discovery, fully and clearly described.
  • Complaints submitted will be answered within 14 days.

Article 14 – Disputes

Agreements between the entrepreneur and the customer (consumer or business customer) to which these terms and conditions apply are exclusively governed by Dutch law.
